Read your insurance policy, and find out exactly what your insurer is contractually obligated to do in this situation.
Second EDIT: Not sure how things work in Canada, but in this country, state insurance commissions promulgate regulations that are deemed to be included in insurance policies, whether or not they are actually written into the policy. You should check and see if anything like that could favor you.
Your van is worth a lot less because it has been a) stolen, and b) wrecked while stolen.
The nimrod who left it running to be stolen MIGHT be negligent depending on the facts, and might have insurance to cover this loss. Shake him down.
EDIT: Whoops, family member? As in one of your kids? Or someone who might have their own homeowners or umbrella policy?
If the punks are caught and prosecuted, they will be made to pay restitution, provided you stay on top of the case. Caveat: this can take an eternity. Once in a while I still get a restitution check from property crimes I don't even remember.
I've had vehicles stolen, it's not much fun; be glad you had full coverage on it as it could be even worse than it already is.
