That is not completely accurate. Own a business and refuse service to someone based on their demographic.

Supreme Court heard arguments last December over a suit between a private citizen and a business. The court is having to consider liberties such as free speech and religious freedom. Soooo..constitutinal issues certainly can exist between two non-governmental parties.
