It takes 12 seconds exposure to take a tintype image. The photographer told them all to stay put and don't move. The guy was pointing at the croquet game to act like he was directing it.
He did have a goofy look to him.
We don't really know the personality, and for all we know he could be an intentional criminal, not a victim of the local society. For some reason its cool history.
