Curious to see what Bitog would feel is a fair resolution to a little problem I ran into today. I purchased a voip cable / phone modem off ebay a couple of weeks ago. looking at the sellers feedback it looked very good.I called Comcsat and had the modem provisioned for internet and all went pretty good. wanting to change my home phone service from Verizion to Comcast I set up a day to port my phone over to Comcast. well the tech was here earlier today and we ran into an issue. he said that when he called to provision the modem for phone they are unable to as it was registered and belongs to somebody else. if they install it and I call 911, the dispatcher would send help to the incorrect address. When I bought the modem it was listed as new and never used, obviously it was not new. right now I am stuck either going back to Verizion ( paying a reconnect fee more than likely ) or trying to get another modem and schedule another appointment with Comcast. my main question is what would you expect as an appropriate action from the seller who sold you the modem ?

Thanks for the thoughts so far everybody. what a start to a day off lol !

The seller sold quite a few of them. I am thinking that maybe the other people did not try and activate the phone portion of it. I hate to see another person pay for a new modem only to find out they can not use it. wondering if the seller works for a cable company or has a friend that does, the tech at my house this morning sure thought so. how else could they have all of these modems and at least one ( the one I got ) already is registered to a customer's account. if the unit was truly new it would never have been assigned to a customer. wonder if there is a way to find out the history of the modem? maybe the manufacturer can tell me where it was sold to originally ?

Replace at no expense to you or refund with call tag. It is possible that the seller might not have known the unit was previously provisioned if he acquired it in packaging that looked new. It could have no real use other than the config, lots of ifs there. Is it possible to get it released by the previous owner?

Not sure how I would go about getting the unit released out of another account. I just hope nobody else ends up with this situation. no phone service, a modem that will not work and I am out the purchase price. well I guess I should have known better than to buy an important tech item from Ebay.

Have you looked at the cost of a Vonage box & monthly service? May be less than Comcast. Keep this box for the modem end and use a Vonage box for the VOIP. One nice thing about a seperate VOIP box is you can bring it anywhere there is a wired internet service and have a working phone with a USA phone number.

This happens everytime I cancel internet in my wifes name and call to get it switched to my name.. they initially say it can't be registered with my account because its already in use. Just call and tell then to deactivated it from the other account or have the seller deactivate it.

Actually I'd recommend this:

http://www.newegg.com/Product/Product.aspx?Item=N82E16833617001

I use that and google voice. It's a one time $40 for the box then completely free unlimited local and long distance. Works for me

Have a teenage step daughter that uses this heavily and haven't run into any issues with it yet. I've had it for over a year and would HIGHLY recommend.

update to my situation. heard back from the seller and he assured me the modem is new and set up for Comcast service. he said Comcast is to blame. stated he sold a modem last week and the person had to call Comcast 10 times before they got it right. I did see the same issue when I reviewed the modem on Amazon. I did call the Comcast phone activation number and asked that the guy add my phone number to my modem. he did not even ask for the number on my modem as he said he saw it. I only gave the modem activation csr my mac address hmmmmm ? well the guy said keep an eye on the lights as he had to reboot my modem. when he placed a test call I was on the old verizon line and heard it beep. lights were all lit up on the modem. was assured the home phone number was set up on the emta. hung up and made a test call from my cell and the phone rang. placed an outgoing and it worked fine. my only concern now is that the old Verizon jacks are still active as I can plug in a phone, get dialtone and make an outgoing call. I can not receive calls as they go to the phone plugged right into the modem. ( that is a good sign that a number was ported and not in the correct switch, good thing in my case as it seems Comcast has the number ) I will call Verizon tomorrow and see if they still have me in their switch , recognize the port over and make sure they deactivate the lines in my house. seems tomorrow will let me know if there are any left over issues. still can not believe the guy the tech called could not get the number active on the modem.

You should disconnect the Verizon lines in at the box outside your house.

I presume you plan to feed the Comcast phone via one of your phone outlets.

Not saying you shouldn't call. What I'm saying is physically disconnect your home from the Verizon line in.

I had to do the same with AT&T because the tech forgot to disconnect the in-coming phone line when they set up my uVerse.

I quick trip to the box outside my home, disconnect the home from the phone company side via an RJ-11 connection and I was good to go.

That is a good idea to disco the phone outside. have to see if there is still dial tone on the hone jacks today. I did call the Verizon automated system yesterday and picked option move / transfer phone. heard there was an order on Monday placed and scheduled for yesterday to disco the line. guess I have to see what the time frame is for them to deactivate it, maybe today or Monday. like you said I can just disco the line at the nid. I am not using the phone jacks in the house. have a cordless phone with a base plugged directly into my voip modem. my other phone gets a signal from the base to receive calls. did not want to mess with any of the phone jacks as I am planning on putting the house on the market soon. if the line is still active ( will plug into the nid directly to check for dialtone) on Monday I will have to call them to make sure they have the billing stopped as of last Thursday.
