I saw the video. Any contact by the greeter is unclear. Our member sends the greeter sprawling. Our half-baked philosophers will likely defend him even if he is found guilty because they feel they owe one to "The Man". Taking joy in watching a lowly W-M greeter get sent flying down the aisle doesn't make you a champion of the oppressed, it makes you a loser.

The video isn't the clearest, for sure.
However, I didn't see that Cicero used enough force to send the greeter that far across the floor.
It would be nice if other cameras and angles were available. That way we could see more clearly what happened and not have to rely on Cicero's word, although I won't call him a liar.

In general, it is a good idea to stick one to "The Man" if you think he's wrong.
 
If the video shows Cicero as not having much of a case, why are we beating this to death?

Why are we talking about *THIS* on an oil board? What is to be gained by doing so?

This doesn't make sense...it's not opinion about an oil, computer, brew, nor any other object. Rather, we're talking about an in-progress legal proceeding. BIG difference between the two. If someone involved in the case was to read this topic (or the old one), would it be condemning to him?

I suggest you freeze the frame right at the point where Cicero's arm is at full extension as he shoves the WM guy. Take a look at the way Cicero's feet are planted and his stance.

So the proceeding does not qualify as "any other object" and does not fit the "off topic" forum? Hmm... as far as I know, only religion and politics cannot be discussed on BITOG.

Is it possible there is more than one video angle, but Walmart only 'released' the one video shot they wanted Cicero to see and use in court ??

I'm sure there is more than one video camera recording the entrance and exit areas of Walmart.
 
I have a couple of decades+ experience in martial arts, in the dojo, as well as the ring, and I don't see Cicero generating enough force to send that fellow to the floor and that far away from him.
 
I'd like to thank everyone for the great spark of the day. This has been a good thread. Lots of polarized views and much debate.

I agree and believe that if the "greeter" is so frail, maybe it's not the right job for him. There seems to be some degree of bullying by the bigger guy, enough to force Cicero to make a play. Before you say he overreacted, I think you have to combine the ominous threat of TWO "greeters" or bouncers or whatever. They seem to have targeted Cicero, was there a "beeper" going off that he is supposed to interpret as suddenly waiving his rights? What about deaf people? I bet there are more than a few things in the store "beeping" at any given time. About that Arkansas law concerning automated inventory control or whatever...it looks like the retailers wrote it themselves. Thankfully, I live in a Commonweath. Well-enough is the referenced section about suspicious activity like shoplifting or whatever, asking for human citizens to OBEY an (inventory) machine is a bit much for my tastes. As far as the Police charging the greeter, I just don't see him place a hand...not that it did not happen. Cicero, my advice is to plead and ask for lienency. You could have just walked out, but committed a greater foul instead. Bottom line, in my eyes, was there a crime in progress...a theft? ONLY if there was a crime in progress is there justification for restraining a customer. Like I said, the store HAS to be right. Just grabbing people methodicly or ramdomly for search/scrutiny/detention is not a "right" a business posesses. I got into it at Home Depot after a security dope asked me for a reciept for a BABY GIFT I had paid for. I said, "yes, I have a reciept, in my pocket" which satisifies a reasonable inquiry. The sec guard/dope called over a Philly cop and I still refused. I asked WHO accused me of stealing...."noone". Then why was I being detained with my legal property? Niether the cop nor his supervisor could give me an answer beyond "store policy" and that the cops agreed to provide support for the store security in the deal cut to bring the store into town. My response was that the cops are there to protect citizens, not to enforce "story policy". They agreed. I walked. Rationality wins over force.
 
The reason attorney called you at 4:30 was to "feel" you out, see what frame of mind you are in, so they could prepare for trial. Saying "not a chance" was the worst thing to say, expect to be crucified, ...

Edit: I deleted the rest of what was written here. I've been as hard on Cicero as anyone, but I certainly take no pleasure in the fear and apprehension he is no doubt going through right now. A post that is calculated to add to that apprehension is counterproductive, IMO. G-Man
