Walmart v. Cicero

Some things just keep getting curiouser and curiouser. I fired the attorney and I am not interested in any comments on how dumb that was or that I "need" an attorney.

Anyway, trial is scheduled to start on Monday and last 3 days. So on Friday I gave the persecutor my witness list, as required by court order. I also had received some information from Walmart in response to a subpoena and I gave the persecutor copies of that on Friday. This is a subpoena the judge specifically approved.

So, yesterday at 4:30 I got a call from an attorney for Walmart demanding that I return the information that had sent to me in response to a valid subpoena. I told the attorney, "Not a chance." He started saying something about "Under civil court rules....." I cut him off and reminded him this is a criminal case and the information was evidence in a criminal case and would not be returned. He told me he is going to apply for a court order. I told him that will be fine.

Can you believe this? The persecutor doesn't want me to have information from Walmart so he calls Walmart and tells them to get it back. Or are you going to deny that Bernard?

They sure don't want me to have a fair trial.

Don, I followed your WalMart thread from beginning to end. Things looked pretty good, but I must say that these recent developments don't sound very good.

In any case, keep us up to speed, don't get too grouchy and best of luck to you.

He's going to need it. People who go out of their way looking for trouble usually find it. This case is a good example of that.
 
sounds like gman and cicero17 dont get along?

anyways, i was just at walmart today and the very rude reciept checker stopped me. she wouldnt let me go by because i wouldnt show her my reciept. finally she called store security. some big guy came and i was like are you framiliar with the case of "walmart versus cicero?" thats going on in washington?
the security guy freaked. i know youre real name probably isnt cicero but i bet he knew what i was talking about. i never saw anything like that but he told the reciept checker to let me go and put his hands up.
so i just calmly walked to my car, spent about 5 minutes putting the 2 items i bought in my trunk, and drove away slowly.

I've never had any exchanges with him save the PM he sent me in response to my first post in this thread.

I will say that I think what he did was pointless and self-indulgent.

He could just be trying to bluff you into making mistakes.
 
I spent the last hour reading the posts. Best of luck to you Don. Having been through a few court issues of my own I can relate to what you and your family are going through.
 
Lawyer's monopoly strikes again... Id venture to guess that they are just trying to bleed you of time, effort and sanity (and of course money) so that you will indulge to their desires. Stinks doesnt it? Same thing happened to me when I foiled the insurance company's abilities with an engineering analysis of the motion of the vehicle that destroyed my MB, experts from everything from physics to automobile valuation, with credentials out the wazzoo... In the end all, no matter how right I was, I could never have enough experience, expertise, intelligence, etc. to defeat the lawyer's monopoly... so the option was to settle for pennies on the dollar, or else get the full amount (eventually) but still effectively have pennies on the dollar when all was said and done as far as legal fees went. What a ridiculous, useless system!

While your actions may be questioned by some, and perhaps in reality your action was overwhelming and excessive (I am not making any claims, just saying in theory), the reality is that (a) Wal-mart is a lousy organization no matter what metrics you throw at the analysis (b) while entering may constitute agreement to be searched, withheld, or whatever, this is also a lousy process, as I refuse to be treated like a thief, and have made such comments to the ID checkers (for CC purchases) and reciept checkers at various stores for a long time; and (c) thanks to the legal fee structure and overall poor accessibility of the common person to the legal system, in reality, your actions here are unsustainable overall, unfortunately.

Cause/effect of the pushing aside, from the facts presented, it seems that Wal-mart is pulling apretty lousy stunt, and in the end all, this is an injustice that is unacceptable. Unfortunately you are facing two juggernauts (Wal Mart and their Lawyers), to which I can only say, "Good Luck and All the Best!!!".

First of all, I don't know G-Man, except his unfriendly posts on this subject. A moderator should be moderate, and he is not showing signs of being moderate. His private message to me was pretty much the same.

LT4 Vette, I admit to being a little touchy these days. Your apology is accepted and I apologize for jumping on you. I thought my first post on this thread made it clear that this is a criminal case.

Walmart has filed a motion in the case demanding that the materials provided to me in response to my subpoena, that was authorized in open court, be returned as not relevant and a fishing expedition. The attorney specifically mentioned the video on Youtube as if there is something wrong with posting it. It is obvious that the persecutor, Christopher Baum, and Walmart are going to do everything they can to prevent me from presenting a defense.

Walmart plans to go for an ex-parte hearing at 1:00 today in order to shorten time and docket a hearing Friday at 9:30, during the civil docket, on a motion for a protective order.

Master ACiD, your story is very interesting. I know that Walmart is worried about this because their receipt checking policy is illegal in its implementation if not the whole policy. About the best way they can justify it is to put me in prison.

That's the way it works. All please take note. If a law enforcement officer roughs you up, be sure that an assault charge is coming YOUR way.

"Yes officer, no officer" avoids a boatload of trouble.

I don't see why you are accepting LT4 Vette's apology for anything. You owe him a big apology. This message board doesn't revolve around you or your case, so excuse him if he wasn't hanging off your every word. I wasn't aware of the details case either and based on this childish response, it is indicative of your self-righteous nature. You left that WM looking to be a hero and now you are causing a pile of stress for your family because you are a drama queen. Taking on the biggest juggernaut the corporate world has has seen (without an attorney) tells you just really want attention and you don't care about the negative fallout that will undoubtedly occur.
