Petty Officer 2nd Class Matthew McCabe court martial is taking place at Norfolk Naval Base. The Navy says the trial could last three days. Two other SEALs who were charged with failing to protect detainee Ahmed Hashim Abed were acquitted in military trials last month in Iraq.

I guess an Artlicle 15 wouldn't have been enough? Some JAG types have far too much time on their hands...just like in the RVN a few decades ago.
 
Ahh. I see. Well, if someone is guilty of a serious offence, that isn't always the best move to make. I've administered many NJPs and never ran a bluff, i.e., a case I couldn't have won in court. So I never had anyone refuse to accept one, either. As a matter of ethics and fairness, it was also my duty to warn them of the consequences and penalties of courts martial, so logic seemed to work. Either the facts and witnesses were nailed down, or they weren't worth proceeding on since combat unit commanders should be too busy with other important matters.

In a few instances, I imposed NJP on a "good soldier" who just screwed up (while drunk usually) with NJP minimums to protect them from higher authority (the double jeopardy clause), a few times at significant personal risk to myself for doing it.

All-in-all the MJ system works if you can just keep the vindictives and zealots out of it.
 
If you served in the military, then you know how much Bull [censored] politics you have to deal with on a daily basis.

Stuff like this drives out very good people in our military back to the civilian world.
 
What's our Navy coming coming to? Now gals on subs. We are reverting back to the kind of Navy we had in the latter 70s. What a mess.

Wasn't it a SOC Army 2-star that insisted on the courts marshall, reportedly after being pressured by the Joint Chiefs of Staff? If so, he should have been a man and refused.
 
I think the real shame here is that everyone is reacting from their gut instead of waiting for the trials to pan out and the records to be made public.

If you really want to support your troops, your demand should be that ALL the evidence and trial proceedings be made public so you can speak intelligently.

Agreed, prosecuting these people is an absurdity.

These thugs think they're tough when they're cutting the heads off of civilian newspaper reporters for youtube, but they're just a bunch of crybaby nancy boys when they're caught and roughed up a little bit.

I think that what every real American here is saying is that even if the SEALs did do the actions attributed to them, it's an absurdity to put them on trial for it. Try to keep up, sir.

I'm keeping up just fine. But thanks for your concern.

If you consider yourself a real American, you should care about the truth here, and you should be upholding the principles that separate us from our enemies, including our aspirations to fairness and impartiality in our justice system. You should also have more regard for our mission abroad than to want to exonerate our troops without regard to whether they did anything wrong.

Here's the irony: There's a very real possibility that the SEALs are innocent. But this trial has generated so much publicity that if they are found innocent, there will always be reasonable doubt that they were exonerated due to public opinion and political pressure. We have turned this situation from a tough one into a bona fide catch-22.

If you cut down the law to punish the devil, you have nowhere to run when he turns around to face you.

I would try to discourage my children from joining the military for this very reason. The 'rules of engagement' are so strict that our soldiers are handcuffed (and as such endangered).
