in 09 and 10, it appears I did not claim the making work pay credit. I think. I called for and received transcripts from 09 and 10 and although $400 (single) is listed, the deduction from federal and ultimately my refund does not take that $400 in account, meaning my refund was just exactly my federal sans making work pay minus tax. I used 1040EZ for those years.

Can I claim 09 and 10 using the 1040x today?

I can't google search a proper answer and I figure asking on some forums I frequent might be a bit better than using the cesspit of yahoo answers, and a preliminary feeler before consulting someone for $$.

If it's listed on your 1040 EZ line 8, it's accounted for. What most likely happened is you gradually got the credit throughout each year via less withholding, and that is why your refund wasn't as big as you thought it should be.

I believe you have to re-file your 09 and 10 returns. You can't carry over unclaimed deductions or credits, especially ones you failed to claim two and three years ago.

You would file amended returns.

I believe you can file a corrected return, can't recall the proper form # necessary off the top of my head.

Find out where your local walk-in IRS service center is located, they will have the info and the forms you need.

Yes, you can still file an amendment for 2009 tax year up until 04/15/13 (3 years from the due date of the return). For the 2010 you have until 04/15/14.

Bottom line: was line 8 (the making work pay refundable credit) added to 7 and 9? Those 3 items represent 7) federal taxes withheld during the year from your paychecks, 8) the making work pay refundable credit), and 9) the Earned Income Credit.

The total of all 3 of those items (line 10) is what goes against line 11, the amount of income tax you owe.

Like I said, when the making work pay credit was law, the IRS issued new withholding tables so employers would withhold less taxes from each paycheck so the credit was distributed more evenly throughout each year.
