child support advise pls

Hi guys, im very depress atm, its 6am and I really dont know what to do. I just receive a letter say I own 3000 dollar child support. I try get this story short and fast. mabe some you older and been thru can help.

My ex and I have 6 year old daughter, she is latin, since my child born, i was 18 and my ex was 16, we married and divorse a year later, and I alway pay ( i put cash in mail and send to her house, some time I put under her door inside her house) she monthly without court order til after we divorse i recieve court order have to pay child support. and if im not pay her child support, court can take my driver licence way. from that day i start write her check, in case my driver licene got suspen because i fail to pay child support, and I got proof I been pay her child support.

that start in june 2010 i pay her in check. now I got the paper from she, I saw those month she fill out that I pay child support, those 2009 and 2010 i missing alot, i like [censored] ? I dont have those month i pay in record cause i send her cash , only those month after we divorse then court order me to pay, that when I write her check and keep record. and the way she fill out those month I pay and I miss, Im sure those she made it up, because I never know I have to pay 220 a month on those 2009 and in 2010, and she fill out that I did pay 1-2 that ammount 220 in 2009 and early 2010, I dint know i have to pay 220 after court told me too that is in june 2010.

so I receive a letter from child support say I have 10 day to dealing with my ex about this moneys or contact the office for dispute or wat ever, if not after 10 day, they will start collect 3000 dollar.

my ex just having baby with some one, and she been having trouble getting medicare to cover her medicare bill, she not work for last few year, live with her parent and live on my child support moneys, her dad is the one that pay most for my child.

I really dont know wat to do now, thinking sell my car and just pay her 3000 dollar. but its not fair, i been pay, i never miss a month. some time I give her less and some time more, depend i made moneys that moneys .i have nothing left, its hard for me to make moneys, paying child support consider half my check. i live with my parent, but I got alot other bill to pay also.

I agree you need legal help. Contact the place where the child support notice came from monday morning and tell them what has happened. Someone there has a heart and knows the best way to help you.

I'm a Family Law attorney and I deal with situations like this quite often. You need to get a good attorney who has experience in dealing with child support disputes. If you try to tackle this on your own you will get screwed.

Have you talked to your Ex about the situation? Civil conversation can go a long way to resolve the issue.

Because you paid cash, and did not hand it to her personally, you have no proof that she got the money.

A lawyer can help you here, but be prepared to pay another 3K for his work as well.

Typically, lawyers charge by the hour and require a certain amount of money up front (called a "retainer"). How much depends upon the lawyer and the complexity of the case. Clearly it doesn't make any sense to spend $3000 to try to avoid paying $3000 in back child support. Probably what you are looking at here is help getting the amount reduced and establishing a payment plan for the reduced amount.

I really want a loyer, but serious I dont have any extra moneys, event 100 dollar atm. I was thinking when I come talk to her, see what she say and mabe she can help me or recomment me a lawyer or give me option or something. what do u think ?

I don't know about your financial situation or your states regulations but you may qualify for some sort of legal aid,maybe not free but at a reduced rate.
I would do go to to the court house and ask the clerk of courts office for some information on what options if any you may be eligible for,They maybe to at least point you in the right direction.
No way would i have any dealings with you ex without proper legal advice.

In my experience, the people who are in the position of the woman you are planning to talk to see guys like you as one thing: a "deadbeat" dad who doesn't pay his child support. They are not interested in your reasons, excuses, etc. The only thing that makes them happy is cash on the table. If you go in there looking for a sympathetic ear you'll be greatly disappointed.

This is nothing to play around with. Unpaid child support can land you in jail. Beg or borrow, but do what is necessary to get yourself a lawyer.

they say it can be free or reduce cost for lawyer, i will try call them on monday first, see what happent, then go from their. I have 10 day left, so I gotta do this quick. Im not try run away from not paying child suppport, its just not fair I own that amount and every month I send her moneys. I was never miss a month, before court order i have to pay 220, i did pay around 100-200 weekly or every month to help baby out, every time I have moneys I send, I was young and dumb dint learn how to write a check and keep record, I never thought this day would come like this. I wish I was writing check all those year. reason I dint write check, cause my ex was illegal to unite state ( she legal now, after we married and did paper work ). since she illegal and have no ID to match the check name, that y I give she cash. I love my ex, few time she hit me in the face cause I dint do the way she want. and one time she hit me 2 time in the car on my face, and she left i stop the car try stop she, and she keep walk away, i accident hit her on the face, not punch, but just hit her light, and few day later i got arrest for domestic violent, they say I hit she, but dint say anything about she hit me, but since she was illegal, i dont want any happent to her, so I just accept the charge without let them know that she hit me too. tbh i take alot bullet for my ex, but she keep bring me all kind of [censored]. I dont know how long til I can take it any more.

She will get the necessary medical care whether you paid 100% of child care or didn't pay a penny. Trust me on this, even if she was illegal and only been in this country for a few days and was pregnant and needed to go to the hospital.... she would get the same exact treatment as if she was a US Citizen and had the very best health insurance you could buy.

I know my lawyer sister charges approx $300 an hour and that doesn't include all the phone calls, email, faxes, snail mail...etc, etc that you will be billed for.

Since she was dishonest and says you were not paying, she will just have to visit the ER for all her medical needs since she claims she can not get Medicare coverage.

She knows how to manipulate both you and the system, with the domestic violence charge etc. Plus that looks good with divorce lawyers having a paper trail that you're the "bad guy".

Your paper trail of recent cashed checks might help show you're responsible. If you can't get a lawyer see if you can get a deal like paying an extra $25 a month from here into eternity. She may have a new lawyer or system-gaming friend putting ideas in her head about the previous cash "never happening." A possible cross-examination might be "why didn't you complain sooner" but it seems there isn't a statute of limitations.

May be worth looking into how much they can dock your wages, eg 50%, and how close to or over that point you already are.

I wonder if (hindsight and all) you could have made the checks payable directly to your child. You've been too nice, illegals can cash checks with a Matricula Consular and besides once you write the check it's not your problem anymore. I dont know guys, right now im very confused and nervous, scary, im confused its because i been giving she moneys for my child, and its because i dont have it in record all those year, she using that to say im not paying. in my mind i never ever thinking not going to send her moneys, or miss a payment.

This has little or nothing to do with fair/moral/right .. IT IS THE LAW !!
You are in a legal mess and need a lawyer to get you out.
There is a gunfight about to break out and you are unarmed and overwhelmed, you just don't realize it.
Get a good gunslinger lawyer to help you defend yourself or you will be toast.
