63 in 35 zone

i could see the 55 sign when i sped up, and the cop was sitting just before it - i know that it's too fast even for 55...

anyway i have to appear in court.
what are my options?
 
Go to a defensive driving course, present your certificate to the judge and more than likely your speed will be reduced so that it doesnt affect your license or insurance.

Its your word against his and the outcome will more than likely be in his favor if you attempt to fight for a 63 in a 55.
 
Go to court - there's a possibility that he won't show. It's worked for me before. Just cross your fingers and hope he's out sick that day. Usually, they don't care enough to come in unless you did something worse than speeding. Of course, if it's a small town...
 
63 in a 35 is a hefty fine and a lot of points...In this case I would consider one of those traffic lawyers to go to court with you...Some people that have used them down here have had their cases thrown out.

You most find a good one cause there are a lot of bad ones out there who just rip you off.
 
No, it'll just cost some cash. Maybe a couple hundred and a defensive driving class a couple points off your license. It's not riyadh or anything, you'll keep your hands and feet

Depends on the laws in your state.

If there is a risk that you could lose your license, then bring a lawyer. Otherwise, ask for a trial, and just tell the judge it was a momentary lapse, you're a good driver with a clean record, you saw the speed sign etc., you're very sorry, you'll pay the fine, and you want to plead guilty to a lesser violation to avoid the points.
 
Just checked the NC laws - I'd get a lawyer, your laws suck. In texas you'd be out the door, but it seems that speeding in excess of 15mph is a suspended license and (I think I have this correct) 3 points. You can also be jailed for up to sixty days.

I think in Indiana if the difference is more than 20 mph, the driver goes to jail overnight.

The OP would be wise to research what the regulations are in his state.
 
Wow, that is severe. The fines have gone up, but you're not automatically anything until 31mph over here in PA. Then it was an automatic hearing ..which wasn't a hearing at all, but rather a deposition where you explain why you were doing 31mph over. This is dated, but first hand experience/knowledge

If this was a "campaign" where they grabbed a bunch of people over the day, the magistrate may just reduce it to the fine without points. It was a common technique here in various boroughs. We had a 25mph zone that was wider and straighter than a 35mph zone. Even school buses drove fast through it. The JP just reduced it to 10mph/no points. The speed traps were so ineffective at changing behaviors, they finally installed stop signs so close together that speeding was a waste of time.


Just about everyone races to get where they're going. It's just a matter of time before you become the catch of the day.
 
Around here that's "felony speeding." You're lucky to have gotten a summons and not handcuffs.

I would go to court and, well, make up my mind there. They probably let any officer from the dept prosecute and there should be one there. When I went (instead of pleading guilty thru the mail) anyone who passed a stopped school bus HAD to be there to explain themselves.

When I went to court they herded everyone in and took attendence, you had the options of pleading guilty, going straight to trial, or having a pow-wow with the cop which would then lead to trial. I wore my funeral suit; few others did, and the cop let me off.

Court is public so you can go ahead of time and see how ill prepared and rude most other speeders who think they can get off are.
