Seems like in solving one safety concern, they added a couple more.

Trailers should sit as level as possible relative to the hitch point, so sometimes dropping it is necessary, but the strength of that one bolt is the weak point, and like someone else said, the ball mount they are using might act as sort of a double jointed pivot with only one bolt.

What they did might work in a pinch, but doesn't seem like a great idea.

It's very unsettling knowing that people in my state are doing things like this. And he had to have drilled a hole in that in order to mount the ball. I wonder if he was wondering why it didn't already have the proper hole, or if he "knows what he's doing" and knows he's not using it properly.
 
I wanted to take a picture of a car at Family Dollar (I buy Alpo there). The trunk area was dented up, and he had installed 2 barrel locks on the trunk (that you would use for a shed door). Covering the rust was what looked like duct tape with a pattern on it.
 
I've read before that hitches prevent rear end accidents. Maybe that's what he's using it for.
